513 Apartments (operating under affiliated entities, collectively "513 Apartments," "we," "our," or "us") is a residential and commercial property management company headquartered in Cincinnati, Ohio. We own and manage residential rental properties throughout the Cincinnati metropolitan area.

This Privacy Policy describes how we collect, use, disclose, and protect personal information about prospective tenants, current tenants, former tenants, and other individuals who interact with us in connection with our properties and services.


2. Information We Collect

We collect personal information in connection with our rental and property management activities. The categories of information we may collect include:

Identification & Contact Information
- Full legal name, date of birth, and government-issued ID
- Current and prior addresses
- Phone numbers (including mobile numbers used for SMS communications)
- Email addresses
- Emergency contact information

Financial & Employment Information
- Income verification documents (pay stubs, bank statements, tax returns)
- Employer name and contact information
- Credit history and credit score (obtained via third-party screening)
- Rental payment history and account balances

3. How We Use Your Information

- Rent collection and accounting: Processing payments, tracking balances, and managing security deposits
- Property operations: Scheduling and coordinating maintenance and repair work with our service team
- Legal compliance: Complying with applicable federal, state, and local laws, including Ohio landlord-tenant law, Fair Housing requirements, and other regulatory obligations

We do not sell your personal information. We do not use your personal information for advertising or marketing purposes, and we do not share it with data brokers or advertising networks.


4. SMS & Text Messaging

513 Apartments may communicate with tenants and prospective tenants via SMS text message for customer care and property management purposes.

SMS Program Disclosure

Message Types: We send SMS messages only for customer care purposes, including maintenance request updates, lease-related inquiries, unit availability confirmations, move-in and move-out coordination, and responses to tenant-initiated communications. We do not send promotional or marketing messages via SMS.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Consent: By providing a mobile phone number in connection with a rental application, lease agreement, or direct communication with our team, you consent to receive SMS messages from 513 Apartments related to your tenancy or inquiry.

Opt-Out: You may opt out of SMS communications at any time by replying STOP to any message we send. After opting out, you will receive a single confirmation message and no further SMS messages unless you re-enroll.

- Message and data rates may apply depending on your mobile carrier and plan.
- Message frequency varies based on your tenancy and service needs.
- Carriers are not liable for delayed or undelivered messages.

5. How We Share Your Information

We do not sell, rent, or trade your personal information. We may share your information only in the following limited circumstances:

Service Providers & Contractors: We share information with maintenance contractors, screening services, property management software providers, and other vendors who assist us in operating our properties and delivering services to tenants. These parties are authorized to use your information only as necessary to perform services on our behalf.

Credit & Background Screening: With your authorization, we submit rental applications to third-party screening companies that conduct credit checks, criminal background checks, and rental history verification in accordance with the Fair Credit Reporting Act (FCRA) and applicable Ohio law.

Legal Requirements: We may disclose your information when required by law, court order, or legal process, or when we believe disclosure is necessary to protect our rights, comply with a judicial proceeding, or respond to a government request.

Business Transfers: In the event of a sale, merger, or transfer of ownership of a property or entity, tenant information related to that property may be transferred to the successor owner or operator, subject to the same privacy protections described in this policy.

Safety: We may share information if we believe in good faith that disclosure is necessary to prevent imminent harm to any person or to address an emergency involving the health or safety of a tenant or other individual.


6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, to comply with our legal obligations, resolve disputes, and enforce our agreements. In general:

- Active tenant records are maintained throughout the duration of the tenancy and for a minimum of seven (7) years thereafter, in accordance with Ohio landlord-tenant law and our recordkeeping obligations.
- Rental applications from individuals who did not become tenants are retained for a minimum of two (2) years.
- Security deposit records are retained in accordance with ORC § 5321.16 and applicable law.
- SMS opt-out records are maintained indefinitely to honor opt-out requests.

When personal information is no longer needed, we dispose of it securely.


7. Security

We implement reasonable administrative, technical, and physical safeguards to protect the personal information we collect from unauthorized access, disclosure, alteration, and destruction. These measures include limiting access to personal information to employees and contractors who have a legitimate need to know it in connection with their duties.

No method of transmission over the internet or electronic storage is completely secure. While we take reasonable precautions, we cannot guarantee the absolute security of your information. If you believe your information has been compromised, please contact us immediately.


8. Your Rights & Choices

Depending on your location and the nature of your relationship with us, you may have the following rights with respect to your personal information:
