1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your relationship with 513 Apartments in connection with rental applications, tenancy, maintenance services, and all related communications and interactions. By submitting a rental application, executing a lease agreement, or otherwise engaging with 513 Apartments, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not proceed with an application or tenancy. These Terms are in addition to, and do not supersede, any executed lease agreement or addenda between you and 513 Apartments. In the event of a conflict between these Terms and a signed lease agreement, the lease agreement controls.


2. About 513 Apartments

513 Apartments is a residential and commercial property management company based in Cincinnati, Ohio. We manage a portfolio of residential and commercial rental properties throughout the Cincinnati metropolitan area. References to "513 Apartments," "we," "our," or "us" in these Terms refer to 513 Apartments and its affiliated property-owning entities as applicable to the specific property you are inquiring about or residing in.


3. Rental Applications

Submission of a rental application does not guarantee tenancy or create a binding agreement. All applications are subject to review and approval at our sole discretion in accordance with our written rental criteria and all applicable Fair Housing laws.

Application Fees: Application fees, where charged, are non-refundable and cover the cost of background and credit screening. Payment of an application fee does not guarantee approval.

Screening Criteria: We evaluate all applicants using consistent, written criteria that consider factors including income verification, credit history, rental history, and background check results. Our screening practices comply with the federal Fair Housing Act, the Ohio Civil Rights Act, and all applicable local ordinances. We do not discriminate on the basis of race, color, national origin, religion, sex, familial status, disability, or any other protected class.

Consumer Reports: By submitting an application, you authorize 513 Apartments to obtain consumer reports, including credit reports and background checks, through third-party screening providers in accordance with the Fair Credit Reporting Act (FCRA). If your application is denied in whole or in part based on information in a consumer report, you will receive an adverse action notice as required by law.

Accuracy of Information: You represent that all information provided in your application is true, accurate, and complete. Providing false or misleading information is grounds for denial of your application or termination of any resulting tenancy.


4. Lease Agreements

A tenancy is only established upon execution of a written lease agreement signed by both parties. All lease terms, including rent amount, lease duration, security deposit requirements, and tenant obligations, are set forth in the executed lease agreement and any applicable addenda.

Security Deposits: Security deposits are collected and held in accordance with Ohio Revised Code § 5321.16. Security deposits will be returned or accounted for within the timeframe required by Ohio law following the termination of tenancy. Deductions may be made for unpaid rent, damages beyond normal wear and tear, and other charges authorized by the lease and applicable law.

Lease Renewals & Non-Renewal: Unless otherwise stated in the lease agreement, tenancies will convert to month-to-month upon expiration of the initial term. Notice requirements for non-renewal or lease termination are governed by the executed lease agreement and Ohio landlord-tenant law.

Subletting & Assignment: Subletting, assignment of the lease, or permitting unauthorized occupants is prohibited without prior written consent from 513 Apartments. Unauthorized subletting is grounds for lease termination.


5. Payments & Fees

Rent is due on the date specified in your lease agreement. Failure to pay rent when due may result in late fees, formal notice of delinquency, and, if uncured, initiation of eviction proceedings in accordance with Ohio law and the terms of your lease.

Accepted Payment Methods: Accepted payment methods are specified in your lease agreement or communicated by our management team. Payments submitted via unauthorized methods may not be credited to your account.

Returned Payments: Returned checks or failed electronic payments may result in returned payment fees as specified in your lease, and 513 Apartments reserves the right to require future payments in certified funds following a returned payment.

Application of Payments: Acceptance of a partial rent payment does not constitute a waiver of 513 Apartments' right to collect the remaining balance or pursue available remedies for non-payment.


6. Maintenance & Repairs

513 Apartments is committed to maintaining its properties in compliance with applicable housing codes and Ohio's implied warranty of habitability under ORC § 5321.02. Tenants are responsible for promptly reporting any maintenance issues, damage, or conditions that may affect habitability or the safety of the property.

Submitting Requests: Maintenance requests must be submitted through the channel designated by 513 Apartments (phone, text, email, or property management portal). Emergency maintenance issues involving risk to health or safety should be reported immediately by phone.

Access for Repairs: You agree to provide reasonable access to the unit for authorized maintenance personnel to perform repairs, inspections, and property improvements, subject to proper notice as described in Section 9. Unreasonable denial of access may constitute a lease violation.

Tenant-Caused Damage: Tenants are responsible for damage to the unit or property caused by the tenant, occupants, guests, or pets beyond normal wear and tear. Repair costs for tenant-caused damage may be billed to the tenant and deducted from the security deposit or pursued as a separate obligation.

Alterations: Tenants may not make alterations, improvements, or modifications to the unit — including painting, installing fixtures, or modifying utility systems — without prior written consent from 513 Apartments. Unauthorized alterations may result in restoration charges.


7. SMS Communications

By providing a mobile phone number in connection with a rental application, lease agreement, or communication with our team, you consent to receive SMS text messages from 513 Apartments for customer care and property management purposes.

- No Marketing: We do not send promotional or marketing SMS messages. All SMS communications are transactional and customer care in nature.
- Opt-Out: Reply STOP at any time to stop receiving SMS messages from 513 Apartments.
- Help: Reply HELP or contact us at (513) 409-1935 for assistance.
- Rates: Message and data rates may apply. Message frequency varies based on your tenancy and service activity.
- Carriers: Carriers are not liable for delayed or undelivered messages.

Opting out of SMS communications does not affect your tenancy or any obligations under your lease. Important notices may still be delivered via other means, including email, postal mail, or posted notice as required by law or your lease agreement.


8. Tenant Conduct & Property Use

Tenants and their guests are expected to conduct themselves in a manner that is respectful of other residents, neighbors, and the property. The following are prohibited and may constitute grounds for lease termination:

- Creating or permitting conditions that constitute a nuisance, including excessive noise or disruptive behavior
- Engaging in or permitting illegal activity on or near the premises
- Keeping unauthorized pets or animals in violation of the lease or applicable addenda
- Storing hazardous materials or prohibited items on the premises
- Operating a business from the unit without prior written consent
- Tampering with, disabling, or covering smoke detectors, carbon monoxide detectors, or other safety equipment
- Damaging or defacing common areas, building exteriors, or shared systems
- Parking inoperable or unregistered vehicles on the property in violation of applicable ordinances or lease terms


9. Entry & Inspections

513 Apartments and its authorized agents may enter a rental unit with at least 24 hours advance notice for purposes including:

- Making or inspecting repairs, maintenance, or improvements
- Conducting periodic property inspections
- Showing the unit to prospective tenants or purchasers
- Verifying occupancy or compliance with lease terms

In cases of emergency — including fire, water intrusion, gas leaks, or other conditions posing an immediate risk to health, safety, or the property — entry may be made without prior notice. All entry rights and procedures are governed by Ohio Revised Code § 5321.04 and the terms of the executed lease agreement.


10. Limitation of Liability

To the fullest extent permitted by applicable law, 513 Apartments shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your tenancy, except where such liability arises from our gross negligence or willful misconduct.

513 Apartments does not guarantee uninterrupted availability of utilities, amenities, or services that are the responsibility of third-party providers. Tenants are encouraged to obtain renters insurance to protect personal property. 513 Apartments is not responsible for damage to or loss of tenant personal property.


11. Indemnification

You agree to indemnify, defend, and hold harmless 513 Apartments and its officers, employees, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or occupancy of the premises; (b) your violation of these Terms or any lease agreement; (c) damage or injury caused by you, your occupants, or your guests; or (d) your violation of any applicable law or regulation. This obligation survives the termination of your tenancy.


12. Governing Law & Disputes

These Terms and any disputes arising out of or related to your tenancy or relationship with 513 Apartments are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any legal action or proceeding relating to your tenancy shall be subject to the jurisdiction of the appropriate courts of Hamilton County, Ohio.

Nothing in these Terms limits any rights you may have under Ohio landlord-tenant law, including the Ohio Landlord and Tenant Act (ORC Chapter 5321), or any other applicable consumer protection statute.


13. Modifications

513 Apartments reserves the right to update or modify these Terms at any time. Material changes will be communicated to active tenants via email or written notice. Your continued tenancy following notice of an update constitutes acceptance of the revised Terms, to the extent permitted by your lease and applicable law.

These Terms do not constitute a lease agreement, create a landlord-tenant relationship, or obligate 513 Apartments to rent any particular unit to any individual.
